These Terms of Service govern access to and use of the Bois-Franc Grove & Hawthorn website and online store. By using the store, you agree to these terms.

Language of Contract

A French version of these terms and all related consumer contract documents must be provided before a Québec consumer may expressly choose to be bound by the English version. The consumer's choice must be informed, voluntary, and made only after the French version has been presented.

Eligibility

You must have the legal capacity to enter into a binding agreement. If you permit a minor to use a device or account under your supervision, you remain responsible to the extent permitted by law.

Accounts

You must provide current and accurate information and protect your account credentials. Notify us promptly if you suspect unauthorized access. You must not impersonate another person or provide false identity, payment, or delivery information.

Acceptable Use

You must not use the store to violate law, infringe intellectual property, transmit malicious code, interfere with security, scrape content without authorization, commit fraud, harass another person, or disrupt the website.

Product Information

We make reasonable efforts to display descriptions, colours, dimensions, sizes, and photographs accurately. Screen settings and reasonable manufacturing variations may affect appearance.

Nothing in this provision excuses a product that is materially different from its description, affected by a hidden defect, insufficiently durable, or otherwise fails to satisfy Québec's legal warranty.

Orders

Submitting an order constitutes acceptance of the disclosed offer where the legal conditions for forming the contract are met. An automated acknowledgement confirms that the order was received.

We will not rely on a general unilateral cancellation clause to avoid fulfilling a valid consumer contract merely because a product became unavailable or a price was displayed incorrectly. If fulfilment becomes genuinely impossible, we will contact the customer and act in accordance with applicable law.

Prices and Taxes

Prices are stated in Canadian dollars unless indicated otherwise. Applicable GST, QST, delivery charges, and other fees will be disclosed before checkout completion.

Taxable Québec supplies are generally subject to 5% GST and 9.975% QST, depending on registration, product classification, exemptions, customer location, and applicable place-of-supply rules.

Intellectual Property

Original store text, branding, graphics, photographs, layout, and other content are owned by or licensed to Bois-Franc Grove & Hawthorn. You may use the website for personal shopping purposes but may not reproduce or commercially exploit protected content without permission.

Mandatory Consumer Rights

Nothing in these terms excludes, restricts, or modifies a legal warranty, cancellation right, refund right, or remedy under the Consumer Protection Act, the Civil Code of Québec, or another law where exclusion would be unlawful.

Liability

Any limitation of liability applies only to the extent permitted by Québec law. It does not exclude liability for personal injury, intentional or gross fault, fraud, or failure to comply with a mandatory consumer obligation.

Changes

We may update these terms prospectively by publishing a revised version and effective date. Changes do not retrospectively alter an accepted contract unless agreed by the parties or required by law.

Governing Law

These terms are governed by the laws of Québec and the applicable federal laws of Canada. A Québec consumer retains the right to bring proceedings before the competent Québec court or tribunal.
